Before the compilation: On March 15, 2004, the General Administration of Quality Supervision, Inspection and Quarantine, the National Development and Reform Commission, the Ministry of Commerce and the General Administration of Customs officially issued the "Regulations on the Management of Defective Automobile Products Recall", which was officially implemented on October 1 of the same year. It has been a full 10 years of history. From the recall of the first Mazda 6 in 2004 to the recent sagitar reversal of the Xuanran wave, the car recall system effectively reduced the harm of defective cars to the safety of the public and property, and created the interests of consumers and the social and economic order. The far-reaching impact has also promoted the development of China's automobile industry. In this issue, the editor will sort out the major changes brought about by the car recall in the past 10 years from different perspectives. Of course, it is more about presenting the status quo of car recalls and revealing the problems that need to be solved in the recall system. Recalling and repairing existing faults is the most effective way to treat defective cars and avoid traffic accidents. In the past 10 years, the frequency and number of car recalls have increased significantly. However, compared with the phenomenal growth rate of automobile production and sales in China, the evolution of the recall system has been significantly slower. There are still some sharp problems in many aspects such as system regulations and recall procedures. In short, the 10-year recall can be described as outstanding contributions and outstanding contradictions.
Nearly 17 million recalls in 10 years Our car recalls have experienced a journey from scratch to nothing in 10 years. According to statistics, from the implementation of the “Regulations on the Management of Defective Automobile Products Recall†(hereinafter referred to as the “Regulationsâ€) to September 30, 2014, in the past 10 years, China has carried out 793 recalls of vehicles and recalled nearly 17 million vehicles. There have been many recalls involving more than 100,000 vehicles, of which Volkswagen recalled nearly 1 million vehicles due to DSG problems.
Due to the particularity of automotive products, information asymmetry between consumers and automakers has caused some product defects to be deliberately concealed by manufacturers, and the introduction of the Regulations effectively constrains manufacturers. According to Chen Yuzhong, director of the Defective Product Management Center of the General Administration of Quality Supervision, Inspection and Quarantine, during the 10 years of the implementation of the automobile recall system, the direct economic loss for the consumers was 23.8 billion yuan. The central government can save 270 yuan for direct economic losses for each car recall. .
In terms of quantity, since the implementation of the "Regulations", the number of car recalls in China has soared. The car recall exceeded 1 million vehicles for the first time in 2009, and reached 5.31 million in 2013. According to the latest data, in the first nine months of this year, China had a total of 125 recalls and recalled 2.135 million vehicles. In the past 10 years, the number of car recalls has not only increased in number, but also the scope of recalls has gradually expanded. In 2006, the AQSIQ included more than 9 passenger cars in the recall scope; in 2009, trucks and trailers were also included in the recall management. More importantly, in 2012, the automobile recall system was upgraded from administrative regulations to administrative regulations, and the penalties for violations of the recall regulations by enterprises were raised from the original maximum of 30,000 to 50,000 yuan to 10 million yuan.
At the same time, with the changes in the consumer environment, consumers' awareness and attention to car recalls is also growing. According to a big data statistic, last year, consumers searched for 9.59 million vehicles, and the focus was more specific and professional.
The system is a strait. The General Administration of Quality Supervision and Quarantine has suffered hardships for 10 years. China’s automobile recall system has made remarkable progress both in terms of influence and development process, but it has to be acknowledged that the current recall system has not been able to effectively solve China’s Many contradictions in the automotive market.
In the car recall, consumers are most concerned about the multinational car companies in the global recall, deliberately ignore the Chinese market consumers, using double recall standards. The joint venture "disregards the innocence", and the independent brand is more than enough to recall the recall. It is not difficult to understand that domestic consumers often complain about the recall of defective cars.
The reason is that China's car recall system is not perfect, and the penalties for problem enterprises are not enough. It is reported that China's automobile recall is mainly handled by the AQSIQ. However, due to various factors, the AQSIQ often fails to produce strong evidence and identification results for defective vehicles, and it is impossible to order relevant enterprises to implement recalls in the Chinese market.
This seems to be the unilateral responsibility of the General Administration of Quality Supervision, Inspection and Quarantine. In fact, Wang Kaiming, an expert from the AQSIQ Defective Product Management Center, said that the AQSIQ Defective Product Management Center collects some vehicles involved mainly through vehicle complaints and media reports. Direct information, but equally important information on vehicle accident information, fault repair information, product injury information, and spare parts suppliers are in the Ministry of Public Security, the Ministry of Communications, etc. The lack of information sharing mechanisms between departments has become difficult to obtain evidence for car recalls. important reason.
The lack of professional, fair and impartial evaluation and appraisal institutions is another important factor restricting the development of China's car recall. Due to the large number and variety of auto parts, the relevant appraisal institutions are inextricably linked with automobile manufacturers to some extent, so the identification results given are difficult to convince consumers.
However, the AQSIQ Defective Product Management Center, which is independent and can guarantee the fairness and impartiality of the appraisal results, is incapable of doing some defective products due to insufficient personnel and insufficient equipment. "The defect product management center currently has only a dozen people, and the same institutions abroad have only a few hundred engineers responsible for the investigation. This is the main reason why consumers often complain about the long investigation cycle of the regulatory agencies." Wang Kaiming said.
Advancing the recall legislation is a high voice. Compared with the mature automobile market, China's annual car recalls are only one-tenth. It is reported that in the United States and Japan, its annual car recall rate is basically more than 100%. The data shows that the number of car recalls in China in the past 10 years is less than that in the United States in half a year. More importantly, the United States, Japan and other places are actively recalling. .
Faced with the obvious gap, experts believe that China's recall system should fully draw on the practices and experiences of developed countries and make necessary changes in procedures, systems and penalties. Legal experts suggest that a special "Defective Product Recall Law" should be enacted to make the recall of defective products legally available. At the same time, the relevant system for recalling defective products is further refined, and some laws are adopted for the lower quality standards and missing problems. Make up for the loopholes.
In the recall process, we can learn from the experience of the United States and Japan, simplify the process of voluntary recall, reduce the cost of recall, and impose stricter penalties on some companies that have implemented the recall system. It is reported that the gap between the recall penalty in China and the United States has reached 175 times.
Zhu Xi, director of the Automotive Safety Technology Research Institute of Tongji University, believes that the country should increase the necessary infrastructure investment and capacity building, enhance the scope of data sharing, and expand the results of accident identification to further enhance the level of China's automobile recall.
At the same time, the smooth flow of information between consumers and car manufacturers and recall authorities is equally important. In some cases where the problem is obvious and the recall is unfavorable, it is largely because the consumer does not accurately reflect the defects of the vehicle through the correct channels. Judging from the information published by the General Administration of Quality Supervision, Inspection and Quarantine, there are not a few invalid information in consumer complaints.
As China's automobile production and sales continue to grow, the number and scope of vehicle recalls will continue to grow at a high rate. How to improve the recall system, accelerate and promote the recall legislation will also become a prerequisite for the automotive industry to enter a benign track, and also the basis for building a car power.
